RFA has submitted an official position to OTIF on the proposal from Switzerland to modify Article 7 § 1 UR CUV (26th Meeting of the OTIF Revision Committee).
ERFA does not support the Swiss proposal for the following 2 main reasons:
- The proposal does not take into account the recent changes in the GCU, which were agreed following 3 years of intense discussions at OTIF-, EU- and sector-level and which entered into force on 1st January 2017.
- The initial assessment concludes that the Swiss proposal does not help to overcome eventual shortcomings with regard to liability issues, but on the contrary will result in higher overall cost for the rail sector and more resources needed following damages caused by a freight wagon.
